

What is an LMIA?
A Labour Market Impact Assessment (LMIA) is a document issued by Employment and Social Development Canada (ESDC) that assesses the impact of hiring a foreign worker on the Canadian labor market. The LMIA process is a key requirement for many employer-specific work permits under the Temporary Foreign Worker Program (TFWP). It determines whether there is a need for a foreign worker to fill a particular job position and whether the employment of a foreign worker will have a negative impact on Canadian workers. The LMIA process ensures that Canadian employers are genuinely unable to find qualified Canadian citizens or permanent residents for the position.
Eligibility Criteria for Employers
To obtain a positive LMIA, employers must meet several eligibility criteria. They must demonstrate that they have made reasonable efforts to recruit Canadian citizens or permanent residents for the job position, such as advertising the position in various media and conducting interviews. Employers must also ensure that the job offer is genuine, that the wages and working conditions meet Canadian standards, and that they comply with labor laws. Additionally, employers must not have any outstanding compliance issues from previous employment of foreign workers.
LMIA Validity and Conditions
A positive LMIA is typically valid for six months from the date of issuance. It allows the foreign worker to apply for a work permit, which must be done within this validity period. The LMIA approval does not guarantee that a work permit will be issued, as the foreign worker must still meet all other work permit requirements. The LMIA specifies the job offer details, including the position, location, and duration of employment, which must be adhered to by both the employer and the foreign worker.
Impact of LMIA on Work Permits
A positive LMIA is crucial for obtaining an employer-specific work permit under the TFWP. It provides evidence to Immigration, Refugees, and Citizenship Canada (IRCC) that hiring a foreign worker will not negatively affect the Canadian labor market. Once a positive LMIA is obtained, the foreign worker can use it to apply for a work permit, which will specify the employer, job position, and location. The work permit will be granted based on the conditions outlined in the LMIA and the worker’s compliance with immigration requirements.
